Nous portons expressément à votre attention que nos prix ne contiennent pas des taxes spécifiques aux États comme p. ex. des taxes sur les droits d’auteurs (taxes sacem non inclus), des droits de douane spéciaux, etc. Les conditions d’un acquittement éventuel de ces taxes tout comme leur montant sont différents dans les divers États. Par example pour la france les montant de la surecop hors taxes pour les CD-R sont € 0,352 et pour les DVD-R or DVD+R € 1,589 par pièce. Au cas où il faudrait payer de telles taxes dans un État, c’est exclusivement le client qui en est responsable en sa qualité d’importateur.
TERMS AND CONDITIONS
It is assumed that customers have familiarized themselves with the terms and conditions of sale prior to placing orders for products found on the www.mmd.lu website. Consumers therefore acknowledge that they are fully aware that their agreement with respect to these terms and conditions need not be formalized by their written signature on this document when customers purchase articles from the Internet boutique. Consumers may save and print these terms and conditions, with the qualification that both saving and printing this document is done under the sole responsibility of the consumer.
Prior to ordering articles, consumers declare that the purchase of these products has no direct relationship with their professional occupation and that such purchases are made strictly for personal use. As a consumer, customers have specific rights that could be negated were it to be discovered that the products and services acquired using the web site are in reality to be used to support professional activities. The MMD online boutique available through the web site provides the following information, including a presentation of the basic characteristics of products being offered for sale:
- The price of each item in Euros, as well as any delivery charges
- Description of terms relating to payment, delivery and implementation of orders
- Terms governing the cancellation of contracts when no time limitation is stated for the contract, or if it extends over one year
Consumers declare that they have basic capacity to commit to these terms and conditions
Article 1: Entirety
These Terms and Conditions convey the entirety of each party’s obligations. The consumer acknowledges accepting, without qualification, the entirety of the provisions outlined in the Terms and Conditions. No general or specific term contained in a document submitted or enclosed by a consumer that is proven incompatible with the Terms and Conditions may be incorporated into these Terms and Conditions.
Article 2: Purpose
The purpose of the these Terms and Conditions is to set out the rights and responsibilities of each party in the framework of online sales of goods and services offered by MMD S.A. to consumers
Article 3: Contractual documents
This contract comprises the following contractual documents, presented below in descending order of rank:
- The Terms and Conditions
- The order. In the event of a contradiction among provisions contained in documents of different ranks of importance, the provisions contained in the document of superior rank will prevail.
Article 4: Date of effect
These Terms and Conditions take effect on the date an order is confirmed. Terms and Conditions apply throughout the period of time necessary to furnish the goods and services provided and are valid up until the date seller warranties expire.
Article 5: Electronic Signatures
When customers double click the order confirmation button they are submitting their electronic signature. This signature has the same validity as a handwritten signature between contracting parties.
Article 6: Order confirmations
Contractual information concerning orders will be sent in the form an e-mail confirmation no later than the time of delivery. If no e-mail address is provided, the information will be sent to a postal address provided by customers in the order from. Some orders may be subject to verification on the part of our staff. If this occurs, you will receive notice by mail of any supporting documents you may be required to submit to finalize your order.
Article 7: Proof of Transaction
Computerized entries stored in MMD’s IT system using reasonable security precautions are deemed proof of correspondence, orders and payments effected between parties. Orders and invoices are archived using a reliable and lasting format that allows reproduction of copies of these documents.
Article 8 : Product information
- 8a: MMD’s web site contains adequate descriptions of its products for sale. These descriptions enable potential customers to familiarize themselves with their basic features prior to placing firm orders
- 8b: products offered online are available only as long as supplies last
Article 9 : Pricing
Products are priced in euros. These prices do not include delivery charges, which are invoiced separately and are clearly stated to customers prior to order validation. Prices include VAT charges on the date of the order. All changes to the VAT rate will be automatically incorporated into product prices advertised on the online boutique. Full payment for products must be made when items are ordered. At no time may sums paid out be considered deposits or down payments.
Article 10 : Method of payment
Payment methods include Visa, MasterCard, American Express, Banktransfer and Papyal.
Article 11 : Availability of products
Orders are executed no later than 24 hours after customer confirmation. Should a product be unavailable due to supplier shortfalls, customers will be informed as quickly as possible and will have the choice of canceling or modifying orders.
Article 12 : Delivery
Products are delivered to the addresses indicated by customers .Customers should check the condition of the packaging of their merchandise upon delivery and use the delivery receipt to indicate any damages caused by the carrier to MMD within one week. Customers may request that an invoice be sent them at their billing address. Deliveries are made by the Post Office’s service Chronopost. While this delivery service is extremely reliable, items may arrive late or be lost, as with any carrier. Should a delivery fail to occur on the date indicated on the shipping notice, please inform us of this through the mail or by calling us. We will contact the Post Office, who will begin a trace. Post Office traces may last up to 21 days, beginning from the date the trace is requested. If the item is found with this period, as occurs in the majority of cases, it will be re-directed to your address. However, if the item has not been located within the 21-day trace period, the Post Office will deem it lost. Only at this time can we send you a replacement product, at our cost. If replacement products are unavailable at this time, we will reimburse you for the cost of the lost products. If replacement products are available, but have changed price on the website during the interval, we will use the new prices and will either issue a check reimbursing you for the difference or request a check from you to cover the increase in price. We decline all responsibility with regard to delivery delays caused by the carrier, especially due to lost items or strikes.
Article 13 : Delivery problems due to the Carrier
Any delivery related issue, including damages to products, items missing from order, parcel damaged, broken items, etc. must be described on the delivery receipt in the “Comments” section and accompanied by the customer’s signature. Customers must additionally confirm their reports of problems by informing the carrier by registered mail within two (2) working days of the delivery date of their claim. Customers must then address a copy of this letter, by mail, to the following address: MMD S.A. 21, Am Bann , L-3372 Leudelange.
Article 14 : Delivery errors
All complaints concerning delivery errors and / or discrepancies concerning type or quality of products with regard to guidelines listed on order forms should be submitted to MMD the same day as the delivery or in all events no later than the next working day following the delivery. All complaints submitted after this period will be rejected.
Article 15 : Product warranty
The provisions of these Terms and Conditions may in no way deprive customers of their legal warranty provided by professional sales entities that guarantee them against the consequences of all hidden defects of items sold. It is expressly stated to customers that MMD does not manufacture the products appearing on its web site and that MMD does not assume any liability in case of defective products. Consequently, liability for any damages suffered by persons or goods due to a defect in a product falls to the manufacturer. Customers may invoke claims based on such liability on the basis of information appearing on the labeling of individual products. Terms regarding the duration of manufacturers’ warranties are stipulated on product specifications sheets. Because components of technical products are updated frequently, MMD can, upon request, provide customers information concerning the availability of spare parts for products offered and how they may be procured.
Article 16 : Returns
Returns of articles can only be accepted for products sent back in their entirety, with their complete and original packaging intact and ready for resale. Any products that are damaged or arrive with damaged original packaging will not be exchanged or reimbursed. Returns are not subject to any penalty other than return costs. Customers exercising there right of return may request reimbursement of amounts paid or an exchange of the product. If the product is exchanged, shipping costs are borne by the customer. MMS will make its best effort to reimburse customers for products returned within two weeks. However, due to the technical nature of products sold, this period may extend to 30 days, particularly when products must undergo a technical check (as with products requiring testing prior to sale). Customers are credited amounts charged to their bankcards by means of a secure transaction if payment was received by that method. Otherwise, they will be reimbursed by check.
Article 17 : Partial non-validity
If one or several of the stipulations of these Terms and Conditions are considered non-valid or declared as such through the application of a law, a regulation or as a result of a final legal decision of a competent court, the remaining stipulations retain their full force and scope.
Article 18 : Non-waiver
The fact that one party does not rely on the breach by another party of any one of the obligations specified in these Terms and Conditions, may not be interpreted in the future as a waiver of the specified obligation.
Article 19 : Article Titles
Should any difficulty arise in interpreting any the heading titles of these articles, or in interpreting any of these clauses, the titles will be declared non-existent.
Article 20 : Applicable law
These Terms and Conditions are subject to Luxembourg law. This is true for both substantive and procedural rules. In the event of disputes or claims, customers should first apply to MMD to resolve disputes amicably.
